Battery Waste Management Rules, 2022 — An Overview

The Battery Waste Management (BWM) Rules, 2022, are formulated on the concept of Extended Producer Responsibility (EPR).

According to the concept of EPR, the producers of batteries are liable for:

  • Collection of waste batteries
  • Recycling and refurbishment
  • Disposal
  • Utilization of collected waste for the production of new batteries

 

This ensures the protection of human health and the environment from the adverse effects of hazardous materials present in waste batteries.

Who is Considered a “Producer”?

The following are considered to be “Producers” as per the 2022 Rules:

Manufactures and sells batteries

Domestic manufacturers who sell batteries within India, for which they have manufactured batteries


Sells batteries under their brand name

Brand owners who sell batteries bearing their brand name


Imports batteries

Including new as well as refurbished batteries

Sells equipment containing batteries

If the equipment is sold under their brand name

All such producers must register with the Central Pollution Control Board (CPCB) centralized portal.

Registration of Refurbishers & Recyclers

All battery refurbishers and recyclers are required to:

  • Register with the respective State Pollution Control Board (SPCB) on the centralized portal

  • Obtain one-time registration

  • Submit quarterly returns in Form 4

Quarterly returns must include:

  • Quantity of batteries collected

  • Quantity refurbished or recycled

  • Quantity of hazardous or other waste generated

Extended Producer Responsibility (EPR) for Batteries

Extended Producer Responsibility under BWM:

Producers of Batteries are responsible for ensuring that waste batteries are managed in an environmentally sound manner to avoid any adverse impacts on the environment and human health.

This includes:

  • Meeting EPR targets for collection and recycling

  • Ensuring proper disposal through authorized entities

  • Filing annual returns on EPR portal

  • Maintaining records of waste battery management

1 Is the EPR registration compulsory for battery producers?
Yes. According to the Battery Waste Management Rules, 2022, all producers, importers, recyclers, and refurbishers are required to register for EPR registration.
2 What authorities grant Battery Waste EPR registration?
The CPCB grants registration for producers through a centralized portal. Recyclers and refurbishers are granted registration by SPCB.
3 What are the consequences if a producer does not register for EPR?
If a producer does not register for EPR, then they may be liable for environmental compensation, product seizure, or prosecution under environmental laws.
4 What kinds of batteries are included in the regulations?
All kinds of batteries are included in the regulations. This includes portable batteries, automobile batteries, EV batteries, and industrial batteries. Defense and space are the only exceptions.
5 What are EPR targets for batteries?
Annual collection and recycling targets are based on the quantity of batteries introduced into the market.
6 How do I file returns?
Quarterly returns are required for recyclers/refurbishes, and annual returns are required for producers on the CPCB portal once it is operational.
7 What is the validity of registration?
The initial validity of registration is for 6 months, but once the online portal is operational, normal validity will be applicable.
